What Is the Visa Waiver Program?

The Visa Waiver Program (VWP) allows foreign visitors from nearly 40 countries to enter the U.S. for up to 90 days without applying for a visa. While this is a benefit for tourists and family members who wish to make short trips to visit relatives, serious complications can occur if the terms of the VWP are violated.

Were You Accused of a VWP Violation?

Foreign nationals who enter the U.S. under the VWP and stay beyond the 90 days allowed by law generally are deemed to have waived their right to contest removal other than through an application for asylum. They are also subject to being administratively removed from the U.S. to their home country without having the case go through immigration court. Such violators are precluded from returning to the U.S. for up to 10 years.

Sometimes, however, Immigration Customs and Enforcement (ICE) will bring these cases to immigration court. This may enable a VWP violator to seek voluntary departure, a form of discretionary relief against removal, and permit return to the U.S. without waiting up to 10 years. This can be especially troubling if the VWP visitor has married a U.S. citizen during his or her time in the country.
