Understanding the US visa process for foreign media employees

South Carolina residents may be interested in the process for obtaining an employment immigration visa for someone working in foreign media. In order to do so, there are a few important requirements that must be met.

Employment visas for professionals can be vital for those who need to enter the United States for work. The U.S. offers one type of employment-based immigration for those who wish to enter the country working for a foreign media company. This nonimmigrant visa, the I visa, has three requirements. The person applying for the visa must be employed by a foreign media outlet, such as a film company, the press or other type of media based in a foreign country. The applicant must be coming into the U.S. to perform functions specifically related to their work for that company. Lastly, the company must have a home office located in a country other than the U.S.

If the foreign media employee, who could be a reporter, part of a film crew or other type of worker, meets these criteria, they may be able to apply for the visa at the U.S. Embassy in their home country. Without this visa, the person cannot legally work for the foreign media company while in the US. The length of stay is determined by the Homeland Security officer at the point of entry, though it may be extended with the filing of the appropriate form after entry.

When a foreign employee is seeking to work in the U.S., a lawyer may be able to assist. The attorney might be useful in filing the correct forms for the proper employment visa. The attorney could also be helpful in extending the employee's stay in the U.S. or assisting them with obtaining a permanent visa.
