Seeking protection from persecution

Addressing your residency status in South Carolina as a foreign national may fit into the category of seeking asylum if you are faced with persecution in your home nation. These issues may be related to your ethnicity, religious beliefs, social status or political beliefs and activities. It may be necessary to demonstrate that either your life or your freedom are at risk if you return to your home, but with complex asylum laws in the United States, it may be difficult to successfully navigate these issues without assistance.

Asylum is typically sought by someone who is already in the U.S. If you have refugee status and are in the country legally, illegally, or on an expired visa, you may need to apply for asylum to obtain formal permission to stay. An individual who may be facing removal from the country may need to demonstrate the potential dangers faced upon return to a homeland.

Cancellation of removal may also be sought if a significant hardship for your parent, spouse, or child who has a green card or who is a citizen can be demonstrated. However, it may be important to demonstrate that you meet certain criteria in this situation. Your time in the country must be at least 10 years, and your moral character must be acceptable. Additionally, you may need to demonstrate that you have not been convicted of certain crimes while in the country.

Because of the complexity of the laws, it may be difficult to represent yourself in such proceedings. Additionally, issues that may be subject to interpretation may require knowledgeable explanation to convince officials of your need for asylum or withholding of removal.
