Foreign nationals who enter the U.S. under the VWP and stay beyond the 90 days allowed by law generally are deemed to have waived their right to contest removal other than through an application for asylum. They are also subject to being administratively removed from the U.S. to their home country without having the case go through immigration court. Such violators are precluded from returning to the U.S. for up to 10 years.

Sometimes, however, Immigration Customs and Enforcement (ICE) will bring these cases to immigration court. This may enable a VWP violator to seek voluntary departure, a form of discretionary relief against removal, and permit return to the U.S. without waiting up to 10 years. This can be especially troubling if the VWP visitor has married a U.S. citizen during his or her time in the country.
