How Do You Challenge the Denial of a Naturalization Application?

There is more than one way to challenge the wrongful denial of a naturalization application. These include:

  • Internal Administrative Review: Under Section 336 of the Immigration and Nationality Act (INA), you may seek an internal administrative review within the local immigration office that denied your naturalization application. The form for requesting this hearing is Form N-336.
  • U.S. District Court "De Novo" Review: If your internal administrative review hearing is denied by the local immigration office, you still have another option. You can file for a "de novo" (i.e., new) evidentiary review of your application in U.S. District Court.
  • Reapplying: In some cases, it is also possible to reapply for naturalization after being denied by USCIS. The form for reapplying for naturalization is Form N-400.
